Terms of Use — Andaaz AI

1. Agreement

These Terms of Use (“Terms”) govern your access to and use of the Andaaz AI mobile application (the “App”), published by ArtsByYaseen, and any marketing website where these Terms are published (the “Site”). By downloading, installing, accessing, or using the App or Site, you agree to these Terms. If you do not agree, do not use the App or Site.

2. The service

Andaaz AI offers AI-assisted tools for photo and video creativity (for example, edits, effects, presets, generations, and related features), as described in the App listing and in-app experience. Features may change over time. The Site is informational only and does not run AI generation or accept uploads for processing.

The App is distributed via Google Play. Your use of Google’s services is also subject to Google’s terms and policies.

3. Eligibility

You must be old enough to enter a binding contract in your country and meet any minimum age required by Google Play and applicable law. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization.

4. Accounts

If the App offers sign-in or accounts, you are responsible for safeguarding your credentials and for activity under your account. Notify us at artsbyyaseen@gmail.com if you suspect unauthorized access.

5. Credits, subscriptions, and purchases

Certain features may require credits or a subscription. Prices, packs, and renewal terms are shown in the App and on Google Play at checkout. Payments are processed by Google Play; we do not store your full payment card details for those transactions.

Unless required by law or Google Play policy, purchases are generally non-refundable once consumed or outside Google’s refund windows. If you have a billing issue, use Google Play’s purchase help flows or contact us with your order details.

6. Your content

You retain ownership of content you upload, subject to the rights you grant us below. You represent that you have the rights to submit that content and that it does not violate law or third-party rights.

You grant ArtsByYaseen a worldwide, non-exclusive license to host, process, transmit, display, and create derivative outputs (including AI-generated results) solely to operate and improve the service you request — for example, running models, delivering previews, and preventing abuse. This license ends when you delete content where the App supports deletion, except where retention is required for legal, security, or backup reasons.

7. Acceptable use

You agree not to:

Use the App for unlawful, harmful, harassing, hateful, or exploitative purposes, or to create non-consensual intimate imagery or deepfakes targeting real people;
Infringe intellectual property, privacy, publicity, or other rights of others;
Attempt to reverse engineer, scrape, overload, or disrupt the App, or bypass usage limits or payment requirements;
Submit malware or content designed to interfere with devices or services;
Misrepresent AI outputs as human-made professional advice (legal, medical, financial, or otherwise) where that could cause harm.

We may suspend or terminate access for violations or risk to users or the service.

8. AI outputs and disclaimers

Outputs are generated by automated systems and may be inaccurate, incomplete, or unintended. We do not guarantee specific aesthetic or commercial results. You are responsible for how you use outputs, including compliance with advertising rules, platform policies, and rights of people depicted.

9. Intellectual property

The App, Site, branding, and our materials are owned by ArtsByYaseen or its licensors. Except for the licenses granted here, no rights are transferred to you. Do not remove notices or marks.

10. Third-party services

The App may link to or rely on third parties (including Google and AI providers). We are not responsible for third-party services or content.

11. Disclaimers

THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ArtsByYaseen AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM YOUR USE OF THE APP OR SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE SIX (6) MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnity

You will defend and indemnify ArtsByYaseen and its affiliates against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the App in breach of these Terms, or your violation of law or third-party rights.

14. Termination

You may stop using the App at any time. We may suspend or terminate access if you breach these Terms, create risk, or where we discontinue the service. Provisions that by nature should survive (including intellectual property, disclaimers, limitations, and indemnity) will survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, excluding conflict-of-law rules. You agree that the courts located in Islamabad, Pakistan have exclusive jurisdiction over disputes, subject to any mandatory rights you may have in your country of residence.

16. Changes

We may modify these Terms. We will post the updated Terms on this page and update the “Last updated” date. Material changes may include additional notice in the App. Continued use after the effective date constitutes acceptance.
